The suit claims Cobb engaged in unethical actions following the death of Kane’s husband, Timothy, and seeks judicial dissolution of three business entities tied to alleged mismanagement. The case highlights serious allegations of misconduct within the legal community, raising concerns about ethical standards and accountability among attorneys in South Carolina.
A shocking lawsuit has emerged from Charleston County, targeting Lowcountry attorney Hal Cobb for allegedly exploiting his client relationship with a grieving widow for financial gain. The suit, filed by Bland Richter LLP on behalf of Pamela Kane, the widow of the late Timothy Kane, aims for the judicial dissolution of three business entities that are reportedly under Cobb’s mismanagement.
Filed in the Court of Common Pleas for the Ninth Judicial Circuit, the legal action accuses Cobb of leveraging his position as Timothy Kane’s attorney and business partner for unethical and unlawful activities against Mrs. Kane and the Timothy P. Kane Trust. Amidst the turmoil surrounding Timothy’s untimely death in July 2024, Mrs. Kane is left fighting to untangle what she describes as a web of deceit woven by Cobb.
The lawsuit brings forth several grave allegations. It claims that Cobb began his attorney-client relationship with Timothy Kane in 2015, subsequently gaining access to Kane’s private financial information. After Kane’s passing, the accusations intensify. Cobb is alleged to have manipulated Mrs. Kane through misleading representations and unauthorized financial transactions, disregarding the established ethical guidelines within the legal profession.
In the lead-up to Timothy Kane’s death, a complex series of estate planning documents were executed, with a total estate value surpassing $42 million. Just days prior to Kane’s passing, Cobb presented a fifth version of the estate plan, raising eyebrows and questions about his motivations. This contentious document supposedly named Cobb as a Trustee of the Timothy P. Kane Trust, gave him voting rights over Kane’s real estate ventures, and shockingly, included a staggering $2.7 million gift to himself.
The legal proceedings are now seeking the dissolution of three limited liability companies: Timco, LLC, 604 Front Street, LLC, and 109-111 Screven Street, LLC. Cobb faces a myriad of accusations including legal malpractice, aiding and abetting a breach of fiduciary duty, and conspiracy. A jury trial has been formally requested as part of the lawsuit, indicating the serious nature of the claims against him.
Meanwhile, Cobb’s attorney, Thomas Pendarvis, insists that these allegations merit thorough investigation, emphasizing that they are not substantiated by factual evidence. Nevertheless, the facts surrounding the improper estate planning actions just before Timothy Kane’s death have placed Cobb and his associates in a precarious position.
Of particular concern are past allegations regarding Cobb’s banking history, which have raised eyebrows about his current role as interim president of the Charleston School of Law. Legal experts have delivered sworn statements, challenging Cobb’s competency in handling estate plans for high-net-worth individuals, further complicating his defense.
As the case unfolds, many within the legal and local community are keenly watching for developments. The allegations assert that Cobb’s actions epitomize a fraudulent manipulation of Timothy Kane’s true intentions, as indicated in previous estate documents. At the heart of this legal storm lies a battle for justice, transparency, and the safeguarding of the rights of vulnerable individuals navigating the complexities of estate management.
With a jury trial on the horizon, the outcome of this high-stakes lawsuit will be closely monitored, not just for Pamela Kane but for the integrity of the entire legal profession in South Carolina. The forthcoming court sessions promise to shed light on the intricate layers of this troubling case, revealing whether Hal Cobb will be held accountable for the allegations against him.
