A significant legal battle has emerged in the heart of Texas, as Dr. Gerardo Vazquez has filed a lawsuit against WellMed Medical Group, seeking more than $1 million in damages. The case centers on allegations of defamation and fraudulent inducement, highlighting serious discrepancies in the terms under which WellMed acquired Dr. Vazquez’s medical practice in 2019.
Dr. Vazquez claims that WellMed misled him regarding promised compensation. Initially, he was assured of a yearly salary ranging between $500,000 and $600,000, a commitment that WellMed allegedly failed to deliver. In addition, he was promised essential resources to support his practice, including two nurse practitioners, a personal assistant, and training for electronic medical records. None of these promises materialized, according to the allegations.
The lawsuit also raises concerns surrounding Dr. Vazquez’s forced divestment from an imaging center, which produced an annual income of $120,000 for him. Such a decision has sparked discussions of potential age discrimination as Dr. Vazquez was 74 years old at the time of the agreement with WellMed.
The situation escalated when WellMed imposed corrective actions against Dr. Vazquez, which included a mandate requiring him to complete medical notes within a specified period of 30 days. He asserts that he complied with this directive. However, the work environment soured further during the COVID-19 pandemic when WellMed eliminated one of his nurse practitioners’ positions, thereby intensifying the already hostile workplace.
Dr. Vazquez was ultimately terminated from his position on October 22, 2020. The circumstances surrounding his departure reportedly involved significant humiliation, as he was escorted out of the premises without an opportunity to recover personal belongings. Post-termination, he was reportedly presented with two options—a noncompete agreement restricting his ability to practice medicine in San Antonio or accepting two months’ salary in exchange for refraining from treating WellMed patients. He chose the latter but claims it was under duress.
Following his termination, WellMed allegedly began communicating to patients that Dr. Vazquez no longer practiced medicine, perpetuating false narratives suggesting his retirement. This misinformation has purportedly caused significant emotional distress and has severely impacted Dr. Vazquez’s professional reputation, forcing him to rebuild his patient base from scratch.
WellMed Medical Group, founded by George M. Rapier III in 1990, is based in San Antonio and is known for providing healthcare primarily to older adults, claiming to care for over 2 million patients across Texas and Florida. However, the organization is currently facing scrutiny amid ongoing legal issues, including a separate lawsuit for defamation filed against them by an insurance broker in San Antonio.
Compounding the controversy, a former WellMed consultant, Miguel Gutierrez, pleaded guilty in a related case involving wire fraud. Past disciplinary actions against Dr. Vazquez by the Texas Medical Board in 2018 for prescribing violations have resurfaced in the media, although he has since rectified those issues.
The lawsuit filed by Dr. Vazquez opens a portal into broader systemic issues within WellMed and raises critical questions regarding employee treatment, contractual obligations, and corporate ethics. As the case proceeds through the legal system, it is poised to offer insights into the intersection of healthcare management and the rights of medical professionals.
