Charleston, South Carolina – The highly regarded Charleston Day School (CDS), renowned for serving some of the wealthiest families in the area, is under intense scrutiny due to allegations of fraud involving federal pandemic aid funds. In recent months, legal battles and revelations surrounding the school’s financial practices have raised questions about its integrity and fiscal responsibility.
At the heart of the matter is the school’s claim during the Covid-19 pandemic that over 50% of its students came from “low-income families.” This statement allowed Charleston Day School to access close to $80,000 from the South Carolina Department of Education as part of the federal government’s Emergency Assistance to Non-Public Schools (EANS) program. More specifically, the school asserted that 50.78% of its students were low-income, a claim that many find hard to believe considering the school’s yearly tuition of $28,190 for kindergarten and $29,675 for grades one through eight.
In February 2022, an article surfaced detailing the dismissal of a trustee from the CDS board, Matt Austin, who was reportedly removed after he questioned the school’s policies regarding federal funds. Austin, a local attorney, alleged that he faced retaliation for attempting to investigate the school’s use of pandemic assistance funding. He and his family subsequently faced significant pushback, including having his three children expelled from the school.
Austin’s subsequent lawsuit included serious allegations against the school and claimed that its leadership engaged in “retaliatory actions” due to his inquiries. In court filings, Austin stated that he had been denied access to a web portal containing important financial records shortly after he began his own investigation into the school’s spending, further fueling the concerns over transparency.
Recent court documents have revealed more troubling details about the school’s finances. Notably, it seems that Charleston Day School treated PPP and EANS funds as if they were regular gross receipts rather than acknowledging them as loans and grants meant for specific purposes. This raises significant questions about whether the school properly utilized these funds according to the requirements of the federal programs they applied for.
Additionally, documents show that while CDS claimed it needed federal assistance to maintain payroll during the pandemic, evidence suggests that the school was financially stable enough to withstand the economic pressures that many other institutions faced at that time.
As new evidence has surfaced, federal prosecutor Emily Limehouse reportedly expressed intent to investigate the allegations made by Austin. During one of Austin’s discussions with Limehouse, she indicated that she believed he was acting as a whistleblower, shedding light on potentially unethical financial behavior within the institution.
Complicating the matter further, the school’s legal representatives have attempted to shift focus onto Austin’s wife, Francie Austin, suggesting that Matt Austin may have breached confidentiality regarding school policies. However, depositions from CDS board members have revealed a lack of concrete evidence to support these claims.
One board member admitted under oath that he had “no information” to confirm that a breach had occurred, indicating that the narrative may not have substantial backing. The situation has raised eyebrows about the underlying motives behind Austin’s removal and the public allegations leveled against him and his family.
As this legal battle continues, Charleston Day School faces considerable scrutiny from both the public and legal authorities. With a crucial mediation deadline approaching, the unfolding developments will be closely monitored.
